[128] This gave rise to the Third Party Rights Act in 1999. Under Section 1, a third party may impose an agreement if it purports to grant a benefit to the third party, either individually or to a member as a class, and if there is no express provision that the person did not intend to apply it. [129] In this regard, the party that asserts that the execution is not contemplated by a third party places a heavy burden. [130] A third party has the same remedies as a person who enters into an agreement and can impose both positive benefits and liability limitations such as an exclusion clause.

[131] The rights of a third party can only be revoked or revoked without their consent if it is reasonably likely that they will use them. [132] 1.
